This Privacy Policy explains how we collect, hold, use and disclose personal information when you visit our website, make an enquiry, book or attend training, communicate with us, or otherwise use our services.

We handle personal information in accordance with applicable Australian privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) where they apply, together with other privacy and record-handling obligations relevant to vocational education and training, licensing and student identification.

Our role and our Registered Training Organisation partners

123 Training Solutions is a training provider and training partner. We are not representing ourselves as the Registered Training Organisation (RTO) for nationally recognised training delivered through our RTO partners.

The applicable RTO is identified on the relevant course information or enrolment material. Where training is delivered under an RTO partnership arrangement, personal information and training records may need to be provided to that RTO so it can meet its regulatory, reporting, assessment, certification and record-keeping obligations.

Our RTO partners have their own privacy obligations and policies. Information held by an RTO after it has been provided to that RTO will also be handled under the RTO's own privacy policy and applicable legal obligations.

Sensitive information

In some circumstances we may need to collect sensitive information, for example health or disability information relevant to safety, learner support or reasonable adjustment. We only collect sensitive information where it is reasonably necessary for our functions and where we have consent or another lawful basis to do so.

Anonymous and pseudonymous enquiries

Where it is lawful and practicable, you may make a general enquiry without identifying yourself or by using a pseudonym. However, we generally need accurate identifying information to make a booking, enrol a learner, verify identity or eligibility, conduct assessment, meet licensing or regulatory requirements, process a USI, or arrange the issue of nationally recognised certification.

Unique Student Identifiers and VET information

Many nationally recognised training courses require a valid Unique Student Identifier (USI). Where relevant, we may collect your USI and related identity information and provide it to the responsible RTO for verification, enrolment, reporting and certification purposes.

The USI system and vocational education and training sector are subject to specific privacy, reporting and record-handling requirements. Information may be handled by the responsible RTO, the Student Identifiers Registrar, the National Centre for Vocational Education Research (NCVER), government departments, regulators and other bodies where required or authorised by law.

Where a separate privacy notice, student declaration or consent is required for an enrolment, USI process, government reporting or an RTO partner, that notice or declaration applies in addition to this Privacy Policy.

Employers and third-party bookings

If an employer or another organisation arranges or pays for your training, we may provide that organisation with information reasonably connected with the service it has arranged, such as booking status, attendance, completion status, invoices or course outcomes. Marketing communications

We may use contact details to send information about our courses or services where you have consented or where otherwise permitted by law. Commercial electronic messages will be sent in accordance with applicable Australian spam laws.

You can opt out of marketing communications at any time by using an unsubscribe facility where provided or by contacting us. Service communications relating to an existing booking, course, assessment, payment or regulatory requirement are not marketing communications and may still be sent where necessary.

Some training records may need to be retained by the responsible RTO or another regulatory body for periods determined by law or regulatory requirements.

If we become aware of a suspected loss of, or unauthorised access to or disclosure of, personal information, we will assess and respond to the incident. Where the Notifiable Data Breaches scheme or another law applies, we will make notifications required by law.

Accuracy of information

We take reasonable steps to ensure personal information we use or disclose is accurate, up to date, complete and relevant for the purpose for which it is being used. We ask you to let us know if your contact, identity, licence or other relevant information changes.

Accessing and correcting your personal information

You may contact us to request access to personal information we hold about you or to ask us to correct information that is inaccurate, incomplete or out of date. We may need to verify your identity before providing access or making changes.

In some circumstances the law permits or requires us to refuse access. If that occurs, we will explain the reason where we are permitted to do so.

We will acknowledge and investigate privacy complaints and respond within a reasonable timeframe. If your complaint relates to information handled by an RTO partner, we may need to refer or coordinate the matter with that RTO.

If you are not satisfied with the outcome and the Privacy Act applies to the matter, you may be entitled to make a complaint to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

Children and young people

Some training courses may be available to people under 18, subject to course, licensing and RTO requirements. Where appropriate, we may require the involvement or consent of a parent or guardian and will take reasonable care when handling the personal information of young people.

We may update this Privacy Policy from time to time to reflect changes to our services, technology, RTO partnerships or legal and regulatory requirements. The current version will be published on our website with the date of the latest update.
